AI Terms of Use — AlgoCloud

These AI terms of use govern how AlgoCloud AI Wizard processes your data. AI Wizard is a new EXPERIMENTAL feature under heavy development.

Use of AI Features in AlgoCloud

Certain features of this platform use artificial intelligence (“AI”) and machine learning technologies developed by the Company and/or trusted third-party providers, including OpenAI, Anthropic (Claude), or other equivalent partners (“AI Partners”).

By using these AI features, you acknowledge and agree that your text inputs, strategy logic, and strategy results may be transmitted to and processed by these AI Partners to generate automated outputs, analyses, or recommendations.

The usage of AI features is governed by the section Artificial Intelligence Features in our updated AlgoCloud License and Service Terms.

Artificial Intelligence Features

AI Features — “AI Features” means functionalities within the Software or the Platform that use artificial intelligence/machine-learning technologies (provided by us or integrated third-party providers) to generate, transform, summarize or analyze content based on your prompts or inputs.

Beta/reliability — AI Features may be beta and subject to change. Outputs can be inaccurate, incomplete or outdated; always review them before use.

Operational logging (no opt-out) — To operate, secure and troubleshoot the AI Features, we temporarily log your prompts, system responses and related technical metadata. These logs are access-restricted, used only for operation/security/troubleshooting, and are deleted after 5 days (unless reasonably extended to handle an incident or to comply with law). No opt-out is available. We do not use these logs to train or improve models.

Ownership of your content — As between you and us, you retain ownership of your prompts and the outputs you lawfully generate. You grant us a limited licence to host, process and transmit your prompts/outputs solely to provide, secure and improve the AI Features (and, for improvement, only until you opt out).

Sensitive and third-party data — Do not submit special-category data, personal data of third parties or confidential information. You are responsible for ensuring you have the right to input any content and for complying with applicable law when you use the AI Features.

No investment or professional advice — Outputs generated by the AI Features are for information only and do not constitute investment, financial, legal, tax or other professional advice. You are solely responsible for validating any outputs and for how you use them, including any trades or other decisions you make based on them.

The AI Features are predictive/probabilistic models; their accuracy, completeness and timeliness cannot be guaranteed. We accept no liability for any loss or damage arising from your reliance on AI outputs or your use of the AI Features.

Abuse of AI Features — You must not use the AI Features in any way that violates applicable law, including to commit, facilitate, or attempt any unlawful or criminal activity, or for any other unlawful purpose. We may suspend or terminate access where we reasonably suspect misuse.

Data Collection and Processing

The AI system may process the following types of data for operational, analytical, and improvement purposes:

  • Text prompts or inputs provided by the user,
  • Trading or backtesting results,
  • Strategy code, logic, and performance data,
  • Anonymized technical and diagnostic information.

Data Sharing with AI Partners

Your anonymized and encrypted data may be securely transmitted to AI Partners for processing. These providers may temporarily handle such data to generate requested outputs or maintain service quality, but they are contractually bound to comply with strict confidentiality, security, and data protection standards.

The Company does not sell, rent, or trade any user data, and ensures that any third-party processing complies with applicable laws, including the EU General Data Protection Regulation (GDPR) and similar international frameworks.

No Warranty or Guarantee

The AI features and all outputs are provided “as is” and “as available”, without any express or implied warranties. The Company does not guarantee:

  • The accuracy, reliability, or profitability of AI-generated results,
  • That outputs are suitable for live trading or investment decisions,
  • The uninterrupted or error-free operation of AI services.

AI-generated content is probabilistic, may contain errors or biases, and should be used for informational and research purposes only.

WARRANTY EXCLUSION: THE USER HEREBY ACKNOWLEDGES, THAT THE AI WIZARD AND ANY RELATED SERVICE OR DOCUMENTATION IS PROVIDED AND LICENSED “AS IS” TO THE FULLEST EXTENT PERMITTED BY LAW, AND THE COMPANY HEREBY DISCLAIMS ALL OTHER CONDITIONS, INDEMNITIES, GUARANTEES, REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, ARISING FROM LAW, CUSTOM, PRIOR ORAL OR WRITTEN STATEMENTS OR OTHERWISE WITH RESPECT TO THE PLATFORM AND/OR ANY OF ITS COMPONENTS AND ANY RELATED SERVICE OR DOCUMENTATION, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE SATISFACTORY QUALITY, AND NON-INFRINGEMENT OF ANY LAW OR REGULATION.

Limitation of Liability

To the fullest extent permitted by law, the Company, its affiliates, employees, contractors, and partners shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to:

  • Trading or financial losses resulting from AI-generated recommendations,
  • Data errors, omissions, or inaccuracies in outputs,
  • Service interruptions, downtime, or outages,
  • Processing of data by external AI Partners.

LIABILITY EXCLUSION: TO THE MAXIMUM EXTENT PERMITTED BY THE LAW, THE USER AGREES THAT UNDER NO CIRCUMSTANCES SHALL THE COMPANY BE LIABLE TO THE USER, OR ANY OTHER PERSON OR ENTITY CLAIMING THROUGH THE USER, FOR ANY INCONVENIENCE, DIRECT OR INDIRECT DAMAGES, INCLUDING ANY LOSS OF PROFITS OR OTHER DAMAGES (“LOSSES”), WHETHER ARISING OUT OF THIS AGREEMENT, STATUTE OR OTHERWISE ARISING OUT OF OR IN CONNECTION WITH THOSE, CAUSING USER’S INABILITY TO ACCESS OR USE THE PLATFORM DURING ANY DOWNTIME, OUTAGE OR DISCONTINUANCE OF THE PLATFORM, WHETHER OR NOT THE DAMAGES ARE FORESEEABLE AND WHETHER OR NOT THE COMPANY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation applies even if the Company was advised of the possibility of such damages. The Company assumes no responsibility for loss of strategy data, capital, or reputation resulting from use or misuse of the AI services.

User Responsibility

You remain solely responsible for the accuracy, quality, and security of the data you submit. You agree not to include any personal, sensitive, or confidential information unless absolutely necessary.

All use of AI-generated outputs is at your own discretion and risk.

Consent and Acceptance

By using or enabling any AI-powered feature, you acknowledge and consent that your text inputs, strategy results, and strategy logic may be anonymized, encrypted, and processed by third-party AI Partners for the sole purpose of operating and improving the platform.

If you do not agree with these terms, you must not use any AI-powered feature or functionality within the platform.
